Shipment

Your order will be fulfilled by the delivery date set out in the Order Confirmation or, if no delivery date is specified, then within a reasonable time as of the date of the Order Confirmation, unless there are exceptional circumstances. The delivery date will be arranged by us in accordance with our operators in the area of the delivery and will vary based on the delivery address, type of Products and other relevant factors. Products shall be delivered to the address indicated by you in the order proposal.

 

Shipping times and costs

The purchased product(s) shall be delivered by a courier service selected by MOGI Caffè S.B.R.L. (Bartolini in Italy; FedeEx in Europe; DHL in the rest of the world). The product(s) will be delivered on working days (thus excluding Saturdays, Sundays and local or national holidays) within a maximum of 7 (seven) working days from the date of the Order Confirmation (except that a force majeure event or unforeseeable circumstance occurs). Please note that once you have placed an order, it is no longer possible to modify your shipping address. Please contact our Customer Service if you have any questions about your order.

In case the delivery has not occurred within the above indicated term, you can contact us by sending an e-mail to the e-mail address askmogi@mogicaffe.it, providing MOGI Caff√® S.B.R.L. with a further 7 (seven) working days term (or such additional period of time ‚Äď if any ‚Äst as may be required by the relevant applicable law, or reasonable in the circumstances) to deliver the product(s), provided that, in case of failure to comply with such term, you are be entitled to repudiate the contract and MOGI Caff√® S.B.R.L., shall, without undue delay, reimburse all sums paid under the contract.

Shipments are free of charge in Italy and Germany. Shipping costs amount to ‚ā¨ 15.00 to all other countries where shipping is available.

 

Product delivery and integrity 

At the time of delivery of the order, we invite you to check the correctness of the documentation and verify its integrity: any damages to the packaging and/or the product(s), or discrepancies in the addressee references or documentation must be immediately indicated in writing to the courier’s delivery note. Except to the extent permitted under applicable laws, once the courier’s document has been signed and you haven’t raised any objection, you may not make any objection to the exterior characteristics of the delivered parcel provided that you are entitled to subsequently raise objections in relation to the any other features related to the product(s) in accordance with the conditions set forth in the following return conditions.

 

The risk of loss of or damage to the Products shall pass to you when you (or a third party indicated by you and other than the carrier) have acquired the physical possession of the product.

 

Lack of conformity 

If a product sold has manufacturing defects or in any case of alleged lack of conformity of the product(s) sold by MOGI Caffè S.B.R.L., it is necessary to notify us of the defect or lack of conformity by sending an e-mail to askmogi@mogicaffe.it and attaching a photo relating to the non-compliance.

 

The legal guarantees established by Articles 129, 130 and 132 of the Consumer Code as defined below, apply to the sale of the product(s). Under these Articles, you have the right, free of charge, to get the product(s) repaired (or replaced) within the limits provided by the law, or, in case of failure of one of the remedies above (according to Article 130, para 7, of the Consumers Code), to have an appropriate reduction in the price of the product(s), or the contract cancelled. You lose these rights if you fail to notify MOGI Caffè S.B.R.L. of the lack of conformity within 2 (two) months from the date on which you detected such lack of conformity. In any event, actions intended to assert a lack of conformity not maliciously concealed by MOGI Caffè S.B.R.L.  shall automatically lapse 26 (twenty-six) months after the delivery of the product(s). Delivery costs for returning the product(s) to be repaired or replaced under this clause, shall be borne by MOGI Caffè S.B.R.L., as well as any costs related to the delivery to you of the repaired or replacing product(s).

 

Right of withdrawal

You may cancel a contract for a Product at any time within 30 (thirty) calendar days for product(s) purchased at full price and within 14 (fourteen) calendar days for discounted product(s), beginning on the day after you received the relevant product(s) (the Cancellation Period). In this case, you will receive a full refund of the price paid for the product(s) in accordance with our refunds policy (described below). To cancel a contract, you must inform us in writing an e-mail to askmogi@mogicaffe.it within the Cancellation Period.

 

Returns and Refunds

We hope you will be delighted with your goods, but if not and you wish to make a return for either a refund or exchange, you can send an e-mail to askmogi@mogicaffe.it indicating the number of the order you would like to return.

Please make sure the product(s) are still in its original condition and placed back in its protective packaging and then returned within 30 (thirty) days for items purchased at full price and 14 (fourteen) days for discounted items. You have a legal obligation to take reasonable care of the Products while they are in your possession. We may have a right of action against you for compensation and no refund will be granted:

(a) if there is evidence that the Products have been already used (open, consume, damage);

(b) if the Products do not have their attached tags;

(c) if part of the Products or accessories, are missing;

(d) if packing materials are missing.

If you return the product(s) because you claim that the product is defective, we will examine the returned product(s) and will notify you of your refund via e-mail within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 2 (two) months of the day we confirmed to you via e-mail that you were entitled to a refund for the defective Product. Product returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us. The cost of sending the item to you in first instance, will be refunded to you only in case such Product was not included in a multiple order.

 

Due to customs restrictions, all returns must be shipped from the same country they were purchased from.

Once your package reaches the warehouse, please allow 7 (seven) business days (depending on peak times) for your return to be processed. If your return does not meet the conditions listed above, the package will be sent back to you. When your return has been accepted, your refund will be issued on the same payment method used for the purchase and you will receive a confirmation email. In the event that it is not possible to refund the money as above, the refund will be made by bank transfer, to the coordinates indicated by you.
